The conference was to be held at Rhodes University tonight and tomorrow to elect a new structure of the provincial Youth League.
The congress was organised by the ANCYL’s secretary general Vuyiswa Tulelo with the assistance of some members of the provincial ANCYL who were in acting positions.
Grahamstown High Court Judge Justice Nomatamsanqa Beshe also declared the disbandment of the ANCYL’s PEC led by Mlibo Qoboshiyane, labelling it "unlawful". Justice Beshe overturned the decision taken by the National Working Committee of the ANCYL last month to disband the EC ANCYL PEC after two chaotic elective conferences.
In the order, Justice Beshe said: "The respondent (ANCYL) is hereby interdicted from holding a provincial congress at Grahamstown or any other place in the Eastern Cape on the 10th of July 2010 or any other date unless such congress is convened at the instance and with the participation of the provincial executive committee in the convening of such congress."
When approached by Grocott’s Mail for comment, Qoboshiyane said [all sic]: "This has been proven that it has been illegal by the competent court of law though we knew that as well politically it was wrong and unfound. The PEC is going to sit and look at the judgement at 3pm this afternoon; after that meeting we are going straight to meet with a team from the national secretary general’s office and possibly the National Working Committee of the ANCYL."
He said the Eastern Cape PEC will prepare for the next congress, however he could not say where it would be held. "We are going to propose a next date of the congress to prepare for a formal, credible elective conference," added Qoboshiyane.
